This Privacy Policy explains how Moana Nursery (“Moana Nursery,” “we,” “us,” or “our”) collects, uses, discloses, and protects information when you visit or use our websites, including https://www.moananursery.com and our online store, and any related pages or services that link to this Policy (together, the “Sites”).

Please read this Policy carefully. It describes the information we collect, how we use it, the choices you have, and the rights available to you under California and Nevada law.

Information We Collect

We collect the following categories of information.

Information you provide to us. When you contact us, sign up for communications, request a service, make a purchase, or otherwise interact with us, you may provide information such as your name, email address, postal address, phone number, and the contents of your message or request.

Information collected automatically. When you visit the Sites, certain information is collected automatically through cookies, pixels, tags, and similar technologies. This includes your Internet Protocol (IP) address, device and browser type and version, operating system, the pages you view, referring and exit pages, the dates and times of your visits, and other diagnostic and usage data. Some of this information may be associated with online identifiers that can be linked to your device or browser.

Information from service providers and partners. We may receive information about your activity on the Sites from the analytics, advertising, and security providers described below.

We do not knowingly collect sensitive personal information (as that term is defined under California law) for the purpose of inferring characteristics about you, and we do not knowingly collect personal information from children. See the Children’s Privacy section below. Nevada law does not define a separate category of “sensitive personal information” for purposes of its consumer privacy law.

Cookies and Tracking Technologies

We use cookies and similar technologies (pixels, tags, web beacons, and software development kits) to operate the Sites, understand how they are used, and support our marketing. We group these technologies into the following categories.

Strictly necessary. Required for the Sites to function, such as maintaining your session and supporting security. These are always active and cannot be switched off through our consent tool.

Analytics. Used to understand how visitors find and use the Sites so we can improve them. We use Google Analytics for this purpose. You can learn more about Google’s practices at https://policies.google.com/privacy.

Advertising and targeting. Used to measure and support our advertising, including showing relevant ads and measuring whether they lead to a visit or action. These technologies are operated by advertising partners and may involve sharing online identifiers with those partners. We currently use Google Ads (including remarketing and conversion measurement), Google Marketing Platform services, and the Meta (Facebook) pixel.

Tag management and security. We use Google Tag Manager to manage the tags on the Sites, and Google reCAPTCHA to help protect forms against automated abuse.

Email. We use Constant Contact to send newsletters and promotional emails to people who request them. You can unsubscribe at any time using the link in any email.

We use a consent management tool to control non-essential cookies and tags. Strictly necessary technologies load when you arrive. Analytics and advertising technologies load only after you accept them through our cookie banner, and you can change or withdraw your choices at any time using the “Cookie Preferences” link described in the Your Privacy Choices section. How We Use Information

We use the information we collect to:

  • Provide, operate, and maintain the Sites and respond to your requests
  • Process and fulfill purchases and service inquiries
  • Send you newsletters, offers, and information you have asked to receive
  • Understand and improve how the Sites are used
  • Measure and support our marketing and advertising
  • Protect the Sites, prevent fraud and abuse, and maintain security
  • Comply with our legal obligations and enforce our agreements

How We Disclose Information

Sale and Sharing of Personal Information

California law defines “selling” and “sharing” personal information broadly. “Sharing” includes disclosing personal information to third parties for cross-context behavioral advertising, whether or not money changes hands.

Nevada law uses a narrower definition of “sale,” which generally refers to the exchange of covered information for monetary consideration to a person who licenses or sells that information to others. Unlike California law, Nevada law does not define “sharing” as a separate category of disclosure for cross-context behavioral advertising.

Because we use advertising technologies that disclose online identifiers and activity to advertising partners such as Google and Meta, we share the following category of personal information for cross-context behavioral advertising: internet or other electronic network activity (such as identifiers, device and browser information, and interactions with our Sites). California law defines a “sale” broadly to include disclosures made for valuable consideration that is not necessarily monetary, so some of these disclosures may also be considered a sale. We do not knowingly share or sell the personal information of consumers under 16 years of age. Nevada law defines a “sale” more narrowly than California law. Under Nevada law, a “sale” generally means the exchange of covered information for monetary consideration to a person who licenses or sells that information to others. We do not knowingly sell covered information as defined under Nevada law, including the information of minors.

Your Privacy Choices

Cookie preferences. You can accept or decline non-essential cookies through the banner shown when you first visit the Sites. To change your choices later, select the “Cookie Preferences” link in the website footer.

Opt out of sharing for advertising. To opt out of the sharing of your personal information for cross-context behavioral advertising, use the “Cookie Preferences” link to decline advertising cookies, or contact us at customerservice@moananursery.com.

Global Privacy Control. We honor the Global Privacy Control (GPC) signal. If you visit the Sites with a browser or extension that sends a GPC signal, we treat it as a request to opt out of the sharing of personal information from that browser.

Email. To stop receiving marketing emails, use the unsubscribe link in any email or contact us at customerservice@moananursery.com.

Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you the following rights:

  • The right to know the categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes for collecting it, and the categories of third parties to whom we disclose it
  • The right to delete personal information we have collected from you, subject to certain exceptions
  • The right to correct inaccurate personal information we maintain about you
  • The right to opt out of the sale or sharing of your personal information
  • The right to limit the use of sensitive personal information, where applicable
  • The right to non-discrimination for exercising any of these rights

How to submit a request. You may submit a request by email to customerservice@moananursery.com or through our contact page at https://www.moananursery.com/contact-us/. We will verify your request by confirming information we already hold about you, and we may decline a request we cannot reasonably verify. You may use an authorized agent to submit a request on your behalf, subject to verification of the agent’s authority.

Our response. We will respond to verifiable requests within the timeframes required by law, generally within 45 days, and we will let you know if we need additional time. If we deny a request, you may contact us to ask us to reconsider.

Nevada Privacy Rights

Nevada law gives Nevada consumers the right to direct certain businesses not to sell specified categories of personal information that the business has collected or will collect. If you are a Nevada resident and wish to make such a request, please contact us at customerservice@moananursery.com.

Retention

We keep personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide the Sites and our services, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Usage and analytics data is generally retained for a shorter period unless we need it longer for security or legal reasons.

Data Security

We use commercially reasonable measures to protect personal information. No method of transmission over the internet or method of electronic storage is completely secure, so we cannot guarantee absolute security.

Transfers of Information

Your information may be processed and stored at our offices and at the facilities of the service providers we use, which may be located outside your state of residence. We take reasonable steps to ensure your information is handled securely and in accordance with this Policy.

Children’s Privacy

The Sites are not directed to children under 13, and we do not knowingly collect personal information from children under 13. We do not knowingly sell or share the personal information of consumers we know to be under 16. The Sites may contain links to websites we do not operate. We are not responsible for the content or privacy practices of those websites, and we encourage you to review their privacy policies.
